Federal Judge Strikes Down Virginia's Amendment Banning Same-Sex Marriage

U.S. District Court Judge Arenda Wright Allen has struck down Virginia's Marriage Laws on same sex marriage, calling them unconstitutional. The federal judge said that the Virginia constitutional ban on same sex marriage violated the right to due process and equal protection of the law under the U.S. Constitution. She said it denies gay couples a fundamental freedom to marry. She did, however, stay the execution of the order striking down the ban until an appeal is heard in the Fourth Circuit Court of Appeals.
